‘Same-Sex Marriages Against Society&Values’- Centre On Inclusion In Hindu Marriage Act

While all the eyes of LGBT community across the nation were on the PIL filed in Delhi High Court’s tp recognise gay marriages under Hindu Marriage Act(1955), the central government on Monday he Centre on Monday opposed a plea seeking legalisation of marriage for gay couples.

Claiming that the Lesbian, gay, bisexual, transgender and intersex marriages are “not permissible” as it is not recognised by “our laws, legal system and our values”, Solicitor General (SG) Tushar Mehta opposed the relief sought in the petition filed last week by four members of the LGBTI community.

“These marriages run contrary to the provisions which are already in place in our society. Our values do not recognise a marriage, which is sacrosanct, between two people of gay marriage,” submitted the Solicitor General before a bench of Chief Justice DN Patel and Justice Prateek Jalan.

On this note, the bench observed that the world over things were changing, but it may or may not be applicable to India. However, the bench has asked the petitioners to file affidavits from members of the community who are aggrieved by the refusal of authorities to register gay marriages.
