Motorcyclist not at fault for crash that critically injured another man in Fort Myers

FORT MYERS, Fla. — Fort Myers Police have an update to a crash involving a motorcycle at the beginning of August.

Police say the crash happened at the intersection of State Road 82 and Park 82 Drive.

An investigation revealed that Joseph Madden had pulled off the roadway before the crash due to a mechanical failure with his vehicle.

Madden's family was inside the vehicle at the time of the crash.

The investigation found that Madden was physically in the westbound lanes of travel, holding jumper cables while trying to flag vehicles down to assist him.

Erion Fiametti, who was driving a motorcycle, didn't see Madden until it was too late.

Fiametti being ejected from his motorcycle, and Madden lost his leg because of the crash, along with several other injuries.

The investigation found Madden at fault in the crash, for violating the right of way of Fiametti.

Madden was standing in the westbound lane of travel, adjacent to the bike lane when he was struck by Fiametti, driving a 2009 Yamaha motorcycle.

Madden was also found to have a blood alcohol content nearly double the legal limit at the time of the crash.

Speed was not a factor in the crash.

Fiametti did not have a motorcycle endorsement on his license and was cited.
